Section 11
Confidentiality of documents
(1) Every person shall have the right to the privacy of personal documents relating to him.
(2) For the purpose of sub-section (1), the following document shall be deemed to be the personal document of the person concerned:-
(a) Certificate of Educational Qualification,
(b) medical history, certificate or medical examination report,
(c) certificate of citizenship, passport, voter's identity card, driver's license or other document of a similar nature revealing identity,
(d) account in the bank or details of the amount in such account,
(e) Checks, drafts, debit cards, credit cards or bank statements or other negotiable instruments related to banking and financial transactions,
(f) Biological or genetic details (biometric data) and Lapche fingerprints,
(g) Ownership certificate related to immovable property or other documents related to ownership of land,
(h) vehicle parts (blue book) or other property ownership documents,
(i) Securities or particulars relating thereto,
(j) Employee provident fund identity card, pension card or other documents of similar nature,
(k) Other documents as prescribed.
(3) No one shall disclose or cause to be made public the personal document of any person in the public body as per sub-section (2).
(4) Notwithstanding anything contained in sub-section (1) or (3), the personal document or any particulars thereof of any person may be made public or made public or any particulars thereof may be studied, investigated or examined in the following cases:-
(a) With the consent of the person concerned,
(b) If an identity card revealing the identity of a person is required for the purpose of availing public services,
(c) In case of an order of a court or an officer authorized by law in connection with a case,
(d) if ordered by a competent authority in connection with the investigation or prosecution of a criminal offence.
